The petitioner prays for issuance of a writ in the nature of mandamus to direct the respondents to construct a metalled road in front of and on left corner of his House No. 1426-P, Sector 45, Gurgaon and to remove encroachments, on HUDA, land abutting his house.

Counsel for the petitioner submits that ever since construction of his house, the respondents have not provided a metalled road. It is further submitted that the land around the petitioner's house has been encroached upon by Jhuggis etc. It is prayed that a direction needs to be issued to the respondents for the removal of these Jhuggis.

Counsel for the respondents states, on instructions from Shri Mohinder Singh, Junior Engineer, Estate Office, HUDA-II, that a metalled road shall be provided to the petitioner, within four months. It is further submitted that as the alleged encroachments are the subject matter of litigation, the respondents are awaiting outcome of the said litigation.

In view of the statement made by counsel for the respondents, the present petition is disposed of with a direction to the respondents to provide a metalled road, as prayed for, within a period of four months of the

receipt of a certified copy of this order and consider removing encroachment after civil litigation comes to an end.
