Petitioners, Hazari Lal, Manju Bala and Bharat Lall @ Bharat Bhushan, who have been summoned under Section 319 Cr.P.C. to stand their trial, along with the already arrayed accused, for the offences under Sections 304-B, 498-A/34 and 120-B IPC in FIR No. 84 dated 15.3.2010 registered in Police Station City Samana, District Patiala, have come up with the present petition under Section 438 Cr.P.C. for the grant of anticipatory bail. This application has not been opposed by the learned State counsel. However, the same has been resisted by learned counsel for respondent No. 2-complainant.

It is an admitted fact that the accused, who were challaned by the police, after investigation, have already been allowed the benefit of regular bail. When such a concession has been granted to them, the same cannot be withheld from the present petitioners, who were found to be innocent during the investigation. They are to appear before the trial court and to make an application for regular bail within a fortnight of the passing of this order. They shall not be arrested till the decision of that application.
