Petitioners, by filing this petition under Section 482 of Code of Criminal Procedure, seek quashing of Daily Diary Report (for short 'DDR') No.27 dated June 8^th , 2011, under Section 324 read with Section 34 of Indian Penal Code (for short 'IPC'), Police Station Kurali, District S.A.S. Nagar (Annexure P-1) and First Information Report (for short 'FIR) No.74 dated June 2^nd , 2011, registered under Sections 323, 341 and 506 read with Section 34 IPC in Police Station Kurali, District S.A.S. Nagar (Annexure P-2). 2. Quashing has been sought on the grounds that the parties have compromised the matter with the intervention of respectables and common relatives. Petitioners and respondent No.2 are brothers. They have tendered Compromise-deed/Affidavit (Annexure P-2) and added that there is no ill-will left and they want to live in peace and harmony in future. Indeed, the offences, for which the petitioners are facing trial, are non-compoundable. Notwithstanding that, there can not be any embargo in allowing the parties to compromise the matter in view of the law laid down by the

Five Judge Bench's decision of this Court rendered in Kulwinder Singh & others Vs. State of Punjab and another, 2007 (3) RCR (Criminal) 1052. By quashing the FIR, the parties will be able to coexist peacefully in future putting the end to the dispute for all times to come.

In view of the above, the petition is accepted,DDR No.27 dated June 8^th , 2011, under Section 324 read with Section 34 IPC, Police Station Kurali, District S.A.S. Nagar (Annexure P-1) and FIR No.74 dated June 2^nd , 2011, registered under Sections 323, 341 and 506 read with Section 34 IPC in Police Station Kurali, District S.A.S. Nagar (Annexure P-2) and subsequent proceedings arising therefrom, are hereby quashed.
