Petitioner seeks the concession of regular bail in a case registered on the basis of a statement made by Manjit Kaur that while she was sleeping in her house along with another lady Surjit Kaur in courtyard of her house, Jhanda Singh entered the house with intention to rape her and gagged her mouth on raising alarm but he escaped. Manjit Kaur subsequently set her ablazed by sprinkling kerosene oil but was saved by her husband. The incident is of 24.02.2011. She died on 11.03.2011 as such offence under Section 306 IPC was added along with offence under Sections 452 & 376

Without expression of any opinion on merits of the case, it is sufficient to observe that in the first statement made by the petitioner to the Investigating Officer, she had mentioned the name of Jhanda Singh to be the culprit but subsequently that name was changed as Jagdeep Singh son of Jhanda Singh. It is also not out of place to observe here that the eye-witness Surjit Kaur has already been examined. She has not supported the case of prosecution and was declared hostile. A copy of her statement has been placed on record.

In view of above circumstances, the petitioner can be granted the concession of bail.

The petition is allowed. It is ordered that the petitioner will be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court.
