This is a petition for pre-arrest bail in a case registered vide FIR No.42 dated 19.05.2011 under Section 366 of the Indian Penal Code (for short ‘IPC’) to which Section 406 IPC was added later on, at Police Station Kulgari, District Ferozepur.

The allegations are that Manjit Kaur was married to the complainant Jaspal Singh and is having two daughters of 5 years and 2½ years of age respectively. She was in contact with her paramour on mobile phone. On 15.5.2011, she mixed something in the food of the complainant and other male members as a result of which they became unconscious and she decamped with 2,14,000/- cash which was lying at home for the purpose of payment of lease money of the land and another 26,000/- available in the house along with 15 tolas of gold and one FD of `10,000/-.

Learned counsel for the petitioner has submitted that the petitioner is an employee of ICICI Bank, Ferozepur and was on duty during the period when the alleged incident took place. He has further submitted that he has been falsely implicated in this case.

I have heard learned counsel for the petitioner and have perused the record with his able assistance from which I have found that the allegation against the petitioner are very serious of enticing away the married woman having two children along with substantial cash and gold. Therefore, the anticipatory bail of the petitioner would hamper the investigation and as such the present petition is found to be without any merit, hence the same is hereby dismissed.
