Prayer in the present petition is for grant of bail pending trial to the petitioner, who is an accused in FIR No. 150 dated 11.8.2010, registered under Sections 364-A, 34 IPC, Police Station, Adampur, District Jalandhar.
The ground on which the bail is sought is that the prosecution is not leading evidence. It is a case in which a boy, aged 19 years, was kidnapped for ransom. He was recovered from the custody of the coaccused, who were arrested from the spot. The petitioner along with Rimpy managed to escape from the spot. They had come at the designated site to collect ransom money for release of the boy.
Learned counsel for the State submitted that it was only on one date that summoned prosecution witnesses had not appeared in court. Thereafter, the witnesses are appearing and the evidence is being recorded. At present, statements of five witnesses have already been recorded.
Considering the aforesaid facts, I do not find it to be a fit case for grant of bail to the petitioner at this stage.
Dismissed.
