The petitioners are father-in-law and mother-in-law of complainant Rupinder Kaur wife of Sukhwinder Singh. The complainant has alleged that she had been maltreated on account of demand of dowry by her husband and other family members

. The petition has been opposed inter alia on the ground that recovery of jewellery articles and other valuable things is yet to be effected.

After hearing learned counsel for the parties, it appears that one of the grievance of the complainant is that Alto car , which was given along with other articles, stands sold by the petitioners and that they have not handed over the istri dhan of the complainant despite demand. It is not out of place to observe that son of the petitioners had been arrested and was granted the concession of regular bail after suffering remand for one day. Recoveries might have been effected during the period of police remand. It will not be appropriate to enter into the controversies regarding the recovery of the articles but it is deemed appropriate in the interest of

justice to order the petitioners to pay a reasonable amount to the complainant in lieu of the alleged articles, which are claimed by the complainant,to be in possession of the petitioners.

Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioners will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. They will hand over a bank draft in the name of the complainant Rupinder Kaur for a sum of Rs.1.00 lac to the investigating officer within a period of one month. It will be open to the investigating officer to hand over the said bank draft to the complainant. It is hereby clarified that the above said amount will be adjustable at the time of any final adjudication of the dispute between the complainant and her husband and other family members and will not, in any manner, prejudice any civil rights of the parties.
