Petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Gurdeep Singh alleging that the petitioner and Varinder Singh, non-petitioner has cheated the complainant by taking a sum of Rs.1 lac in cash from him alongwith the passport of son of complainant Khushwinder Singh with a promise that son of the complainant would be sent abroad.

Counsel for the petitioner has submitted that petitioner has been involved in the case because he is an attesting witness to a pronote dated December 11, 2008 according to which the complainant was given an advance of Rs.1 lac by Varinder Singh. Copy of the pronote has been placed on record.
It appears that on account of money transaction between Gurdeep Singh and co-accused of the petitioner, the petitioner has been involved in the case. The petitioner, pursuant to the interim orders, has already joined investigation as per the instructions of ASI Gurpreet Singh imparted to the State counsel.
The petition is allowed and it is ordered that in case of arrest of the petitioner he is ordered to be released on bail to the satisfaction of the arresting officer subject to the conditions that he will join investigation as and when required by the police and that he will not tamper with the evidence or hamper with the investigation in any manner.
