On June 02, 2011, while issuing notice of motion, following contentions of learned counsel for the petitioner were noticed:-
“It is the contention of the counsel for the petitioner that the petitioner is not named in the FIR. He has been involved in the case on the basis of a statement made by his co-accused Darshan Lal, wherein it has been alleged that Darshan Lal purchased the wheat from Sucha Singh-petitioner, who is holding a Government Depot in village Hakimpur in the name of his daughter-in-law through one Swaran Chand r/0 Achhli gate Batala. He contends that during investigation the said Swaran Chand has been found innocent. For making such a statement, reliance has been placed by the counsel on the order dated 21.5.2011 passed by the Addl. Sessions Judge, Gurdaspur, wherein the Investigating Officer had suffered a statement in this regard and on the basis of which the application of Swaran Chand was filed by the Court. He accordingly, prays that the allegations against the petitioner, thus, in the light of the person through whom the wheat was being

sought to have been sold by the petitioner cannot be sus-
tained. ”
Learned counsel for the petitioner submitted that the petitioner has already joined investigation.
Learned State counsel, on instructions from ASI Joginder Singh, submitted that the petitioner has joined investigation and his custodial interrogation is not required.
Considering the aforesaid facts, interim bail granted to the petitioner on June 02, 2011, is made absolute.
The petition stands disposed of.
