Petitioner seeks the concession of regular bail in a case FIR No.27 of 2010 in a case of murder of Surjit Singh. The dead body of said Surjit Singh was found on February 9, 2010 nearing the turning of Ajit Vidalaya School, situated in Amritsar. The petitioner has been connected with the said blind murder on the basis of statements of two PWs Inderjit Singh and Balwant Singh recorded on August 16, 2010 and August 20, 2010 to the effect that the said PWs had heard petitioner talking to his co-

accused regarding the murder of one Dilbagh Singh and Surjit Singh in the present case having been committed by the petitioner and his co-accused. It is also important to point out that petitioner was arrested in a criminal case FIR No. 374 under Sections 399, 402, 379 IPC read with Section 25 of the Arms Act alleging that he was planning to commit robberies in the area of Amritsar, as per the secret information. After the arrest of the petitioner in the said case, he has been involved in the present case and one another murder case in which petitioner has been granted concession of bail; PW Inderjit Singh having been turned hostile.

Taking into consideration the totality of the above circumstances, and the petitioner being in custody w.e.f. August 24, 2010, he can be granted the concession of bail in the present case.

Petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial Court.
