This is a petition for anticipatory bail filed in case bearing FIR No. 31 dated 28.03.2011, under Section 408 IPC registered at Police Station Guruharsahai, Distt. Ferozepur.

On 27.04.2011 the following contention was noticed:-

“Learned counsel for the petitioner has argued that the present FIR is merely an attempt by the complainant to save himself from the allegations of shortage and also to shift the blame on to the petitioner. The matter relates to shortage of 3600 liters of petrol, 700 liters of premium petrol and 1900 liters of diesel.

Even if the arguments of learned counsel for the petitioner are taken on face value, it would still not exculpate the petitioner completely from the shortage. In my opinion it would be in the interest of justice if the petitioner creates a fixed deposit of a sum of ` 1 lac in favour of the Illaqa Magistrate and deposits it with the Court which money(along with the interest accrued thereon) would be released to the petitioner in case he is acquitted. After submitting the said fixed deposit receipt in the Court the petitioner would appear before the investigating officer along with necessary proof thereof.”

Learned DAG, on instructions from HC Balwinder Singh, states

that the petitioner has created the deposit and has joined the investigation.

In the circumstances I deem it appropriate to grant the

CRM-M No. 12423 of 2011

concession of anticipatory bail to the petitioner. In case he is arrested, he shall be released on bail by the investigating officer to his satisfaction subject to the conditions envisaged under Section 438(2) Cr.P.C.

Petition stands disposed of.
