This is a petition under Section 438 Cr.P.C. seeking prearrest bail in a case registered against the petitioner under Sections 379 and 411 IPC at Police Station Mohali, District Mohali, vide FIR No.265 dated 10th September, 2004, wherein the petitioner has been declared a proclaimed offender.
After arguing at some length, learned counsel for the petitioner states that he be allowed to withdraw the present petition with liberty to surrender before the trial court and seek regular bail.
In view of the statement made by learned counsel for the petitioner, this petition is dismissed as withdrawn with the liberty as aforesaid. In case the petitioner surrenders before the trial court within a week from today and applies for regular bail, his plea shall be decided within three days thereafter.
