This petition assails the orders dated 10.09.2011 (Annexure P-5) passed by the Civil Judge (Junior Division), Batala, dismissing the application filed by the defendantspetitioners (hereinafter referred as 'the petitioners') for leading secondary evidence.
The case is already fixed for evidence of the defendants.
Learned counsel for the petitioners wishes to withdraw this petition with liberty to summon the Clerk from the office of Sub Registrar along with the record of concerned sale deeds to prove that Sulakhan Singh used to thumb mark also.
Dismissed as withdrawn with liberty aforesaid.
