This petition assails the order dated 23.02.2011 (Annexure P-1) passed by the Additional Civil Judge (Senior Division), Safidon (Jind), whereby the application filed by the defendants-respondents (hereinafter referred to as 'the respondents') under Order 7 Rule 11 CPC was allowed and the plaintiff-petitioner (hereinafter referred to as 'the petitioner') was directed to affix the ad-valorem Court fee on the plaint.
Balbir Singh-petitioner is stated to have executed the sale deed dated 16.03.2009 in favour of Raj Kumari and thereafter, he has challenged the same on the ground of fraud. The petitioner being executant of the sale deed, was bound to make payment of the Court fee.
No grounds to interfere.
