This is plaintiff's second appeal challenging the judgment and decree of the Courts below whereby his suit for declaration challenging the order dated 1.10.1983 by which juniors of the appellant were promoted, was dismissed.
The case came up for hearing on 12.10.2010. Keeping inview that the only dispute in this appeal is regarding determination of seniority of the appellant and that the suit was filed in the year 1986, the counsel for the appellant was directed to inform this Court, whether the appellant by now, has superannuated or not.
Learned counsel for the appellant has submitted that despite his best efforts he could not trace the appellant and thus, he pleads no instructions.
In view of the aforesaid facts, this appeal is dismissed for want of non prosecution. However, liberty is granted to the appellant in case his grievance regarding determination of seniority still subsists,he may move an application for revival of this appeal.
