In this case, notice of motion was issued on 30.11.2009, however, the respondent could not be served on the given address. On 15.2.2010, the petitioner was directed to furnish the correct address of the respondent for service of summons for 5.7.2010. On 5.7.2010, the Office reported that needful could not be done due to non-furnishing of necessary requisites. Counsel for the petitioner regretted the lapse and sought one more opportunity. The respondent was ordered to be served for 15.9.2010. The petitioner was also given liberty to serve the respondent through her counsel representing her in the trial Court by way of dasti. However, the petitioner again failed to furnish necessary requisites and take dasti summons. On 15.9.2010, the learned counsel again regretted the lapse on his part and sought one more opportunity. The Court directed the respondent to be served by way of dasti for today i.e. 25.10.2010.
As per Office report, no one has turned up to receive the dasti
notice.
In view of the aforesaid facts on record, it seems that the petitioner is not interested in pursuing the petition.
Dismissed.
