Union of India has filed the present appeal seeking reduction of compensation for the acquired land.
Briefly, the facts are that vide notification dated 12.10.1984 issued under Section 4 of the Land Acquisition Act, 1894, Chandigarh Administration acquired land situated within the revenue estate of village Dhanas, U. T. Chandigarh, for setting up of shooting range. The Land Acquisition Collector (for short, the Collector') assessed the market value of the acquired land @ 60,000/per acre. Aggrieved against the award of the Collector, the land owners filed objections. On reference, the learned court below while relying upon earlier award, Ex. P-2, assessed the market value of the acquired land @ ` 1,05,000/- per acre. It is this award of the learned Reference Court which is impugned in the present appeal.
No one has appeared for the parties.
A perusal of the impugned award shows that the learned court below had assessed the compensation for the acquired land on the basis of its earlier award, Ex. P-2. Since the court below had determined the market value of the acquired land on the basis of its earlier award, prima facie, no case for reduction is made out. Further the office has put up a note that the award of the learned court below has been upheld by this court in RFA No. 493 of 1988 Labh Singh (deceased) through LRs. and others vs Union of India , decided on 3.9.2008.
However, as no one has appeared for the appellant in support of its claim, the appeal is dismissed in default.
