Through the present appeal the landowner has approached this court for enhancement of compensation for the acquired land.
Briefly, the facts of the case are that the State of Haryana vide notification dated 1.8.1986 issued under Section 4 the Land Acquisition Act, 1894, acquired land situated in Village Bhiwani Lohar, Tehsil and District Bhiwani, for construction of Hansi-Tosham bye-pass. The Land Acquisition Collector (for short, “the Collector”) vide award dated 8.9.1986 assessed the compensation. Dissatisfied with the award of the Collector, the claimants filed objections before the learned court below. The learned Additional District Judge, while considering the material on record, assessed the market value of the acquired land at ` 35/- per square yard. It is this award, which is impugned in the present appeal.
Learned counsel for the parties submitted that the issue involved in the present appeal is squarely covered by the judgment of this court in RFA No. 2657 of 1989 Dilbag Singh vs State of Haryana, decided on 18.3.2008, whereby the compensation payable to the landowners was further enhanced to ` 80/- per square yard.
No other argument was raised.
Accordingly, for the reasons recorded in the aforesaid case, the present appeal is disposed of in the same terms.
