Union of India is in appeal before this Court against the award passed by learned court below seeking reduction in the amount of compensation awarded to the respondents on account of acquisition of fruit/non-fruit bearing trees standing on the acquired land.
Briefly, the facts are that State of Punjab vide notification issued under Section 4 of the Land Acquisition Act, 1894 acquired land along with fruit/non-fruit bearing trees situated in the revenue estate of Village Padhial, Tehsil Pathankot, District Gurdaspur, for public purpose. The Land Acquisition Collector assessed the market value of the fruit/non-fruit bearing trees. Aggrieved against the award of the Collector, the landowners filed objections which were referred to the learned Court below for consideration, who keeping in view the material placed on record by the parties, enhanced the compensation by adding 133% on the amount awarded by the Collector. It is this award which is challenged in the present appeal.
A perusal of the paper-book shows that dispute sought to be raised by the appellant in the present appeal is merely for ` 4,700.55 paise. The acquisition had taken place more than 22 years back. Prima-facie this court would not like to interfere with the impugned award. However, as no one has appeared for the appellant in support of its claim, the appeal is dismissed in default.
