Surjeet Singh Vs State of Punjab

The landowner is in appeal before this court against the award of the learned court below passed under Section 18 of the Land Acquisition Act, 1894 (for short, 'the Act') seeking enhancement of compensation for the house.

Briefly, the facts of the case are that the State vide notification dated 26/27.11.1982 issued under Section 4 of the Act, acquired the land situated within the revenue estate of Village Ladhal, Tehsil and District Ropar, for public purpose. The Land Acquisition Collector assessed the value of houses and structures on 7.7.1987 at 51,582/-. Dissatisfied with the award of the Collector, the landowners filed objections. On reference under Section 18 of the Act, the learned court below assessed the value of the house of the appellant at 57,027/-. It is this award which is impugned in the present appeal.

The learned court below had assessed the value of the house in question on the basis of report, Ex. R-1, prepared by RW1 Bhupinder Singh and awarded ` 57,027/- as compensation. The assessment report produced by the landowner did not find favour with the learned court below. As there was no other evidence available on record, the court below assessed the value of the house in question as per report, Ex. R-1, prepared by RW1 Bhupinder Singh. Considering the evidence available on record, prima-facie, no case for further increase is made out. However, as no one has appeared for the appellant, the present appeal is dismissed in default.
