This appeal filed under clause X of the Letters Patent is directed against judgement dated 27.10.2009 passed by a learned Single Judge of this Court in CWP No. 5894 of 2009. While allowing the writ petition filed by the respondent, the learned Single Judge has held that the decision of three members Selection Committee dated 25.1.2009 rejecting the candidature of the petitioner for appointment to the post of Professor in the respondent -College was wholly unwarranted and directed the appellantUniversity to approve her candidature for appointment on the post of professor.
At the hearing, Mr. S.C.Sibal, learned senior counsel for the appellant- University has stated that no useful purpose would be served by adjudicating the issue raised in the instant appeal because the petitionerrespondent has already attained the age of superannuation and stand retired. In view of the above agreement of the learned counsel for both
