The petitioner has approached this Court under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to release the arrears of pay along with annual increments which were withheld during her suspension period.

Learned counsel for the respondents states that the entire amount claimed in the writ petition has been released to the petitioner and, therefore, the writ petition has been rendered infructuous. Learned counsel for the petitioner does not dispute the above fact but at the same time states that the amount aforesaid has not been paid

as per the revised pay-scale. He further states that the petition may, however, be disposed of as having been rendered infructuous with liberty to the petitioner to make a representation to the respondents so as to claim arrears on the basis of the revised pay-scale.

In view of the above, the writ petition is disposed of as having become infructuous. It shall, however, be open to the petitioner to make a representation to claim the amount of arrears, if any, which may have become due to her on the basis of the revision in the payscales. In case such a representation is made, the same shall be disposed of by the respondents expeditiously.
