Keeping in view the nature of relief claimed and with the consent of learned counsel for the parties, this petition is being disposed of at the motion stage itself.

The State of Haryana issued a policy dated 1.2.2008 for allotment of residential plots of 100 sq. yards to the persons belonging to S.C. Category and persons living below poverty line. The Govt. also constituted committee which includes the sarpanch of the village as well. The petitioner applied for allotment of the plot. It is alleged that the sarpanch is making allotments by adopting pick and choose policy and the application of the petitioner has not been considered. The petitioner has made a representation/application dated 3.9.2009 (Annexure P-6).

The prayer made in the petition is for a direction to take decision on the representation/application of the petitioner, referred to above. Admittedly, the policy is for the benefit of the persons of S.C

category and the persons living below poverty line. There is nothing in the writ petition to indicate whether the petitioner falls in any of the said categories. However, the respondents are required to consider the application of the petitioner.

In view of the above, this petition is disposed of with a direction to the respondents to decide the application of the petitioner, referred to above within a period of three months from the date certified copy of this order is served upon the competent authority by passing a speaking order.
