Karnail Singh & Ors. Vs State of Punjab & Ors.

The petitioners, while seeking grant of proficiency step-up in terms of the Punjab Government Policy dated 25.9.1998 (Annexure P-4), also impugn the show cause notice dated 14.7.2004 (Annexure P-6) whereby recovery is sought to be effected after re-fixation of their pay.

During the course of hearing, learned counsel for the parties jointly state that the issue involved in this writ petition stands answered by a Full Bench of this Court vide judgment dated 22.5.2009 passed in CWP No.2799 of 2008 ( Budh Ram and others versus State of Haryana and

Consequently, the writ petition is allowed in terms of Budh Ram's case (supra) and while upholding the refixation of pay/salary of the petitioners, the impugned recovery notice dated 14.7.2004 (Annexure P-6) is hereby quashed. It is further directed that if the respondents have already effected any recovery from the petitioners, the same shall be refunded to the them forthwith.
