These petitions have been filed by the Association of Education Colleges (Self Financing) seeking a direction to fill up the left over seats in B.Ed Course at their own level. In the year 2008 a Division Bench of this Court vide a detailed order dated 21.11.2008 passed in CWP No. 17284 of 2008 and other connected matters, had permitted the colleges to make admissions and further directions were issued to the respondent-university and the State to lay down a policy for future. The relevant directions issued by the Court are as under:-

“ (vi) The affiliating University shall for the future examine and take an appropriate decision regarding the mechanism to be adopted for filling up of unfilled excess seats in the institutions for the session 2009-10 onwards. They shall consider whether colleges can be allowed to fill up the remaining vacant seats of their own after the admissions through CET had been completed within the time frame stipulated for this purpose and if so,

the terms on which and safeguard subject to which this can be done. The university concerned shall also be free to devise any other mechanism for filling up unfilled seats considered appropriate.

The parties are left to bear their own costs.”

Despite the aforesaid directions no steps were taken by the affiliating university or the State in this regard. It is under these circumstances that the present petitions came to be filed. Vide interlocutory order dated 17.9.2009 the petitioners were permitted to make admissions in accordance with the directions issued therein. The admissions for the academic session 2009-10 were accordingly made and the admitted students are pursuing the course. These petitions were kept on the board with a view to issue fresh directions in view of the judgement of Hon'ble Division Bench. It is for the affiliating university and the State to lay down the norms for future. It was only on account of the non-compliance of the aforesaid directions that this Court was persuaded to issue fresh directions. However, it is deemed appropriate that the respondents are allowed to make appropriate policy and law down the norms for making admissions in accordance with the directions contained in the order referred to herein above.

In view of the above, these petitions are accordingly disposed of with a direction to the affiliating university as also the State of Haryana to law down the norms in pursuance of the aforesaid directions before issuing prospectus for the academic session 2010-11. The petitioners are also at liberty to make appropriate suggestions to the affiliating university as also to the State Govt. in this regard.
