Bhup Singh Vs State of Haryana& Ors.

The petitioner was initially appointed as Drawing Teacher in Samaj Kalyan High School, Rohat, Distt. Sonepat, a private aided school. Subsequently, the said school was taken over by the State vide order dated 23.5.1994. The petitioner is claiming benefit of the service rendered in the private aided school.

It is admitted by learned counsel for the parties that the issue is squarely covered by a Division Bench judgement of this Court dated 3.3.2003 passed in CWP No. 5540 of 2001, which was followed in CWP No. 6586 of 2008 decided on 24.7.2009, wherein following directions have been issued:-

“ Similarly, Civil Writ Petition No. 13369 of 2007 is allowed and direction is hereby issued to the respondents to count the service rendered by petitioner Nos. 1 to 6 and 9 and husband petitioner no.7 and 7 in the privately managed Govt. aided school for the purpose of grant of pension and pensionary benefits.

All the writ petitions are accordingly allowed in the above

terms. There shall, however, be no order as to costs.”

This petition is, accordingly, allowed in terms of the aforesaid terms. Petitioner shall be entitled to the similar relief.
