Complainant Balwinder Singh has filed this revision petition for modification of the judgment and order dated 7.4.2009, passed by the Court of Additional Sessions Judge, Ludhiana, to the extent that the acquittal of respondent No.3 be set aside and fine of ` 5 lacs be imposed upon respondents No.2 and 3.
Learned counsel for the petitioner states that in view of Section 372 Cr.P.C., which has been recently amended, the petitioner may be permitted to withdraw this revision petition with liberty to file an appeal along with an application for grant of leave to appeal, against the aforesaid
