The petitioner seeks regular bail in a case registered against him on 12.05.2010 for the offences under Sections 324, 148, 149, 506 IPC and Section 307 IPC which was added later on.

The FIR in the case has been registered on the statement of Sayeed Shayad Hassan. The complainant has stated that he is working with his father and dealing in real estate. On 11.05.2010, the complainant received a telephone call from Sheru son of Dharam Pal who was working as a driver with them. He asked the complainant as to why his father was removed from the job. He further asked the complainant to talk with them and come at Samrala Chowk, Ludhiana. The complainant alongwith his friend Lakhwinder Singh reached Samrala Chowk in front of Basant Ice Cream at about 9:45 PM on a Hero Honda motorcycle . There, from an Alto car Dharam Pal (petitioner) and his son Sheru alongwith Romeo and three other unknown boys got down. which Sheru gave a datt blow which hit the left hand of the complainant and Romeo gave a blow with a sharp weapon of iron on the head of the complainant. Then Sheru gave two datt blows on the right arm of the complainant and other persons made the complainant to fall down and started beating him with arms and fists. When Lakhwinder Singh tried to rescue the complainant then these persons inflicted injuries on his person. On seeing him bleeding, these persons fled away from the spot alongwith their respective weapons in their Alto car. The friend of the complainant got him admitted in the CMC Hospital. The motive of the incident was that the petitioner was working as a driver with the complainant, who was removed from the job about fifteen days back. Due to this ill will, the son of Dharam Pal i.e. Sheru and his companions have caused injuries.

In the incident, the petitioner is said to have caused injury on the person of the complainant which is admittedly simple in nature. The fatal injuries have been attributed to Romeo. The petitioner is said to be an old man of 60 years and is a chronic patient with heart bye pass history getting continuous treatment from PGIMER Chandigarh, and at present suffering from kidney complication. He underwent heart bye pass surgery on 06.09.2010 at PGIMER Chandigarh. The trial in the case is likely to take time. The challan in the case has been presented on 13.08.2010. The petitioner is in custody since 16.05.2010.

In the aforesaid facts and circumstances, the petitioner on furnishing of his personal bond and surety to the satisfaction of the learned Chief Judicial Magistrate, Ludhiana, shall be admitted to bail.
