Krishan Vs State of Haryana

The present petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No.10 dated 6.2.2009, under Sections 307/34 IPC and 25 of the Arms Act, registered at Police Station Chhainsa, District Faridabad.

I have heard learned counsel for the parties and have gone through the whole record carefully.

It has been stated by learned counsel for the petitioner that no injury has been attributed to the petitioner and that the injuries have been attributed to co-accused, who is in custody. It has further been contended that petitioner is a student and he has been continuing in custody since 14.2.2009. It has further been contended that only 2 witnesses out of 17 have been examined so far and that trial is not likely to be concluded in near future.

Learned State counsel has not disputed these facts.

Hence, in view of these facts and without expressing any opinion on the merits of the case, the present petition for regular bail filed by petitioner- Krishan is allowed.

Bail to the satisfaction of CJM/Duty Magistrate, Faridabad.
