Prayer is under Section 438 Cr.PC for grant of anticipatory bail on behalf of the petitioner in case bearing FIR No.221 dated 18.7.2009 under Sections 332, 353, 186, 224 and 225 of Indian Penal Code registered with Police Station Hodal.
As per the allegations in the FIR, the petitioner who is Ex - Sarpanch along with help of 8/10 persons had not permitted the complainant-Head Constable Mukesh Kumar to arrest one accused Sewak wanted in FIR No.205 dated 22.5.2008 under Sections 323, 324, 326, 506 and 34 of Indian Penal Code registered with Police Station

Learned counsel submits that a false case has been lodged against the petitioner due to the fact that Sewak had lodged proceedings against one Vinod Kumar, DSP Hodal which has resulted into his transfer to Police Headquarters, therefore, police was inimical towards the petitioner. He further submits that the FIR in which Sewak was wanted has since been quashed by this court on the basis of a compromise. He further submits that he is willing to join the investigation.
Learned State Counsel on instructions from ASI Mam Chand states that since the lodging of the FIRs the police has raided the house of the petitioner 17 times and now proceedings for declaring him as proclaimed offender have been initiated. He further states that the aforesaid accused Sewak, resident of UP is involved in 5/6 other cases.
After arguing for sometime learned counsel for the petitioner seeks permission to withdraw the present petition at this stage.
Dismissed as withdrawn.
