Ram Prakash, Sepo Vs State of Haryana

This petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in case FIR No. 8 dated 2.8.2010, under Sections 420, 467, 468, 471 of the Indian Penal Code at Police Station SVB Hisar.

While issuing notice of motion, the following order was passed by this Court on 1.9.2010:-

“ Learned counsel for the petitioner has submitted that the petitioner had tendered the genuine certificate qua B.A. Examination. At the time of verification, the department had not recorded the correct registration number of the petitioner. Learned counsel for

the petitioner has placed reliance on Annexure P-6 and mark sheet.

In the meantime, in the event of arrest, the petitioner be admitted to interim bail subject to the satisfaction of the Arresting Officer. He shall abide by the conditions envisaged under Section 438 (2) of the Code of Criminal Procedure.”

Learned State counsel, on instructions from Inspector Devi Lal, has submitted that the petitioner has joined investigation in terms of the order reproduced above.

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed and the order granting interim bail dated 1.9.2010 is made absolute.
