The present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioners in case FIR No.315, dated 22.7.2010, under Sections 498-A, 406, 506 IPC, registered at Police Station Bahadurgarh, District Jhajjar.

I have heard learned counsel for the petitioners and have gone through the whole record carefully.

Marriage of the complainant was solemnised on 21.11.2007 with Parvesh Rathee, son of present petitioners. As per the allegations, sufficient dowry was given in the marriage. However, petitioners and their son were not happy with the same. A Santro car was given in the marriage, however, there was a demand of Honda City car. There was a demand of Rs.25 lacs in dowry. There are allegations of physical and mental harassment at the instance of the petitioners and their son. The harassment

was to the extent that the complainant was aborted in December, 2007. Panchayat was also convened. However, petitioners and their son insulted the Panchayat members even. Brother of the complainant had visited Rohtak, i.e, at the house of present petitioners on 4.4.2009 and, however, he was insulted by the present petitioners, and abused, given beatings and thrown out of the house and raised threat to kill. He informed his parents and other family members. They reached there and however, they were also insulted and asked to take away the complainant with them. Thereafter a petition for divorce was filed by son of present petitioners against complainant on vague allegations.

Dowry articles are yet to be recovered from the petitioners. Hence, it is not such a case in which extraordinary relief of anticipatory bail should be granted to the petitioners-accused.

Hence, in view of these facts, and without expressing any opinion on the merits of the case, the present petition filed by petitionersRanbir Singh Rathee and Kamlesh Devi for grant of anticipatory bail is, hereby, dismissed being devoid of any merit.
