Prayer is for grant of anticipatory bail in case FIR No.68 dated 16.7.2009 under Sections 498-A/406 IPC, P.S. Kalanaur, District Gurdaspur.
It is pointed out by learned counsel for the parties that on 5.7.2010, when the case was fixed before Mediation and conciliation Centre, the file had not been sent to the Centre and, therefore, the complainant was under the impression that the case would not be taken up. It transpires that on the application moved by the counsel for the petitionerhusband on that day, file had been summoned and due to non-presence of the complainant, Nodal Agency has sent back the case to this Court.
Learned counsel for the petitioner states that the petitioner is

serving in the Indeian Army and is now posted in Arunachal Pradesh and it is not possible for him to appear in near future.
Learned state counsel, on instructions from HC Sarabjit Singh, states that the petitioner has joined investigation and he is under protection of Court order for the last one year, which he has not misused.
Learned counsel for the complainant states that some items of
gold jewellery are yet to be recovered.
It is not disputed that the divorce proceedings are at the conclusive stage before the ld. District Judge, Gurdaspur.
In view of the developments and the fact that the petitioner has joined investigation, order dated 18.8.2009 passed by this Court is made absolute.
Petition stands disposed of.
