There appears to be vague, uncertain and weak evidence of conspiracy against the petitioner in connection with the murder of Sher Singh. It is apparent that it will debatable during trial if Sher Singh had died an unnatural death as the cremation was attended by his relations, including the complainant. No opinion can be expressed regarding the statements of Dev Singh and Kaur Singh, recorded regarding conspiracy. It will not be appropriate at this stage to consider the relevance of their statements in context to the provisions of Section 10 of the Evidence Act. All these circumstances may constitute a good ground for regular bail but I do not find any extra ordinary exceptional circumstances to grant him the concession of pre-arrest bail despite the fact that the petitioner has joined the investigation.
Dismissed with liberty to the petitioner to surrender before the Illaqa Magistrate and seek the concession of regular bail. It will be appreciated in case the bail application is decided expeditiously.
