Prayer is for grant of regular bail in case FIR No.95 dated 28.2.2010 under Sections 304/34 IPC, P.S Old Faridabad.
Allegations against the petitioner are that he had inflicted kick blows and slaps on Chhokha Nand, who subsequently died. Petitioner is stated to be in custody since 6.3.2010 and the case after framing of charge on 14.6.2010 is now fixed for evidence of prosecution on 18.8.2010. It is also alleged that eye-witness is the wife of the deceased.
In view of the nature of injuries ascribed to the petitioner and the fact that the case is at the stage of prosecution evidence and that the trial is not likely to conclude in near future, petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of CJM, Faridabad.
