The present petitioner is seeking anticipatory bail in case FIR No. 13 dated 12.2.2010 registered under Sections 406/506 IPC at Police Station Nurpur Bedi.
It is stated that allegation against the petitioner is that he has not returned the utensils, which he took from the “Gurdawara” at the time of marriage of his daughter. The said marriage took place in the year 2008 whereas the present FIR has been registered in the year 2010. According to the petitioner, the alleged utensils were returned to one Gurbachan Singh, duly issued the receipt dated 28.4.2009.
Learned counsel appearing on behalf of the State on instructions from ASI Ram Singh states that said Gurbahan Singh denied that he received the utensils.
The same is matter of evidence.
It is not denied that the petitioner has since joined the investigation.
Accordingly, order dated 28.4.2010 is made abso and the petition is allowed as such.
