Prayer under Section 439 Cr.P.C is for grant of regular bail in case FIR No.263 dated 19.10.2007 under Sections 302/120-B/34 IPC, P.S Sadar Khanna, District Ludhiana.
During investigation, it has surfaced that the petitioner had illicit relations with Sarabjit Kaur-wife of the deceased Parkash Singh and on her asking, he has committed the murder of the husband-Parkash Singh. Petitioner is also stated to have suffered an extra judicial confession before Jaswinder Singh.
Learned state counsel, on instructions from ASI Jagir Singh, states that the evidence of the prosecution is being recorded and that the evidence, which has so far been recorded, supports the prosecution case.
Keeping in view the gravity and the nature of offence, no case is made out for grant of concession of bail.
Dismissed.
