Learned counsel for the petitioner states that he limits his prayer to the expeditious disposal of the suit.
Having regard to the fact that this Court has already observed in order dated 8.12.2009 that the proceedings of the suit be carried out on day to day basis, no further directions need to be given and it is always expected of the Trial Court that it shall keep in mind the earlier observations while disposing of the suit and also keep in mind the import and the necessity of making such observations. The Trial Court shall make an endeavour to dispose of the suit preferably within a period of 8 months.
Disposed of.
The prayer for the enhancement of the mesne profits is rejected for the simple reason that it is only an interim measure which is subject to the final adjudication.
