Vide order dated 25.2.2010 passed by Additional Civil Judge (Senior Division) Abohar, the property of the petitioner was ordered to be sold in execution proceedings.
The only grievance of the petitioner before this Court is for realization of a sum of Rs.3,19,820.09, for which his total land measuring 125 kanals 14 marlas worth more than Rs.1 crore, is being put to auction. However, Mr.Vikas Chatrath, Advocate, who is appearing on behalf of the respondent decree-holders has stated before this Court that only that portion of the property of the petitioner shall be put to auction which is sufficient for satisfaction of the decree in the auction sale which is yet to be fixed. Shri Vikas Chatrath, learned counsel has also pointed out that this very statement was suffered by the counsel for the parties on 9.1.2007 before the Executing Court.
In view of the aforesaid stand taken by the parties, No further order is required to be passed. The decree holder shall abide by its stand taken before this Court.
