Challenge in the present petition is to the order dated 3.2.2010 passed by the learned court below on an application filed by the decree-holder seeking appointment of local commissioner for execution of the sale-deed.
When notice of motion was issued on 19.3.2010, learned counsel for the petitioner stated that sale-deed had not been executed till that date. Today, learned counsel for respondent no. 1-decree holder submitted that the sale-deed had in fact been executed on 26.2.2010 even before filing of the petition in this court.
Considering the aforesaid fact, no relief can be granted to the petitioner as the impugned order has already been implemented.
Dismissed.
