The grievance of the petitioner is that the representation submitted by the petitioner has not been decided though this Court vide order dated 20.4.2010 directed the respondent to decide the same within eight weeks from the date of receipt of the copy of the order.

A perusal of the contempt petition filed before this Court shows that the liability of Rs.15,53,582/- was created against the petitioner as on 30.11.2008. The petitioner was further issued a communication dated 19.9.2008 pointing out that the arrears amounting to Rs.20,24,707/- are payable by the petitioner.

The liability to pay tax arises under the Punjab Motor Vehicles Taxation Act, 1958. Such liability created under the Act cannot set at naught by submission of a representation.

At this stage, learned counsel for the petitioner wishes to withdraw the present petition with liberty to avail such other remedies as may be available to the petitioner, in accordance with law.
