This appeal has been filed against the concurrent judgments of the Courts below dismissing the suit of the plaintiff/appellants for possession of property which they had allegedly purchased from Hansu.

Counsel for the respondents has raised a preliminary objection regarding non-impleadment of original plaintiff No.3 and defendant No.1 in the memorandum of appeal. Apart from other grounds, the lower appellate Court dismissed the appeal on the ground of non-impleadment of necessary parties relying upon a judgment of the Hon'ble Supreme Court

rendered in Ch. Surat Singh (dead) and others vs Manohar Lal and others, AIR 1971 SC 240.

I find that this issue has neither been raised in the grounds of appeal nor any arguments have been addressed by counsel for the appellants to show that the finding arrived at by the lower appellate Court is wrong. No contrary judgment of any Court has also been brought to my notice. It is also noteworthy that even before this Court these persons have not been impleaded. In the circumstances, I am constrained to dismiss this appeal on the ground of non-impleadment of necessary parties.
