This appeal has been filed against the concurrent judgments of the Courts below partly decreeing the suit of the appellant and directing a fresh reappraisal of the Annual Confidential Reports of the appellant for the period 1992-93, 1993-94 and 1994-95.

Admittedly, originally the performance of the appellant was recorded as 'below average' and consequently his grading was also recorded as 'below average.' On a representation the successor of the Reporting Officer reappraised the performance of the appellant and found it to be good. However, the grading was not changed. It was in those circumstances that the appellant filed the instant suit. As mentioned above the suit has been filed for direction to the respondent-Government to reappraise the

Annual Confidential Report of the appellant.

During arguments the controversy has been narrowed down. Learned counsel are agreed that it would be now deemed that the Reporting Authority has assessed the performance and grading was also given. On that basis the Reviewing Authority and Accepting Authority shall reappraise the grading of the appellant and pass a fresh order within three months from today. If as a result of reappraisal the grading of the appellant is changed to his benefit then all the necessary consequences which may be due would be released within a period of three months thereafter.

Consequently this appeal is disposed of in the above terms.
