The Metro Heart Institute, Faridabad issued ‘ brought dead certificate ’. Claimant-Surjit Kaur, in her evidence, duly stated that deceased Surjit Singh was not suffering from blood pressure or any other disease. The deceased died due to chest pain, and he was declared ‘brought dead’. He died due to heart attack caused during the course of his employment. She was duly cross-examined. The appellant-company (respondent before the Commissioner) was not able to produce any evidence otherwise, nor was it able to shake the testimony of the witnesses. It is established that deceased-Surjit Singh was brought dead to the Institute and was not suffering from any other disease. He was 40 years of age. He died at his work place as a result of heart attack, caused due to extreme pressure of work. The claimants, herein, are the widow wife, three minor children and mother of the deceased. The appellant-company is, therefore, liable for the compensation under Sections 3 and 4 of the Workmen’s Compensation Act, 1923. There is no ground to interfere with the Award dated 31.10.2008 passed by the Workmen’s Compensation Commissioner and Assistant Labour Commissioner, Mohali.
