Heard the learned counsel for the parties at length.

The petitioner is aggrieved of the order dated 17.03.2009 (Annexure P-3), passed by the Director, Village Development and Panchayats, Punjab, Chandigarh, whereby the proceedings against respondent No.2 for taking disciplinary action have been dropped. Earlier, an enquiry was ordered to be conducted by the District Development and Panchayats Officer, Ludhiana, which was forwarded to respondent No.1 for passing appropriate orders.

Learned counsel appearing for the petitioners has challenged the impugned order Annexure P-3, primarily, on the ground that respondent

No.1 has not given any reasons while passing the impugned order. From the perusal of the order impugned, it appears that even though it is stated that charges against the petitioner have been proved, but in the last paragraph without recording any reasons, proceedings have been dropped.

In view of the above circumstances, the impugned order dated 17.03.2009 (Annexure P-3), is hereby set aside and the matter is remitted back to respondent No.1, for passing a fresh order with due application of mind and after affording an opportunity of hearing to the parties concerned within a period of three months from the date a certified copy of this order is made available to the authority aforesaid. No costs.
