It is admitted by learned counsel for the parties that the issue involved in the present petition is squarely covered by a judgement of this Court passed in CWP No. 5688 of 2008 decided on 28.5.2009.
In view of the above position, the petitioner is also entitled to the similar relief. The arrears of the petitioner would be restricted to three years preceding the filing of the writ petition. This petition is accordingly disposed of in terms of the aforesaid judgement.
