The petitioner, who is working as Leading Fireman in Sunder Nagar Fire Station, Ludhiana, has filed the instant petition for directing the respondents to promote him to the post of Sub-Fire Officer from the date his juniors were promoted to the said post.

Admittedly, juniors to the petitioner were promoted in the year 1998-99 and after about five years of the said promotion, the petitioner served a legal notice dated 28.7.2005 (Annexure P-7) to respondent No.2, which was ordered to be decided within a period of two months vide order dated 27.9.2005 (Annexure P-8), passed by this Court in CWP No. 15509 of 2005, titled as Jeet Singh vs. State of Punjab and others. It is the case of the petitioner that in pursuance of the said order, the Municipal Corporation,

Ludhiana, decided the aforesaid representation vide order dated 9.11.2005 (Annexure P-11) with the observation that the Government is the competent authority to pass an order regarding the promotion. It is the further case of the petitioner that the Government did not decide his representation. In view of these facts, if the Government has not decided the representation of the petitioner, he should have approached the Government to decide the same in accordance with the directions of this Court. No such notice or representation was ever given to the Government. In these circumstances, I am not inclined to entertain this petition.

Dismissed.

However, it will be open for the petitioner to make representation to the Government to consider his claim in accordance with the directions of this Court vide order dated 27.9.2005 (Annexure P-8), passed in CWP No. 15509 of 2005, titled as Jeet Singh vs. State of Punjab and others.
