The petitioner, who retired as Senior Assistant on 31.7.2007 on attaining the age of superannuation from the services of the Punjab State Tubewell Corporation, now renamed as Punjab Water Resources Management and Development Corporation Ltd. (respondent No.4 herein), has filed the instant petition for issuing direction to respondent No.4 Corporation to make payment of 24 years ACP benefit, which according to the petitioner was due with effect from 9.5.2007, and leave encashment under Rule 8.61 of the Punjab Civil Service Rules.

It is the case of the petitioner that the amount of leave encashment was sanctioned and approved, but the same was not paid, as the funds for the purpose had not been received from the Head Office. It is

further case of the petitioner that thereafter, with regard to the aforesaid two claims, she gave a fresh representation dated 16.4.2009, copy of which has been annexed with the petition as Annexure P-17, to respondent No.7, but the same has not been considered and decided so far.

In view of the aforesaid facts, after hearing counsel for the petitioner, without issuing notice of motion as it will un-necessary delay the matter, this petition is disposed of with a direction to respondent No.7 to consider and decide the representation dated 16.4.2009 (Annexure P-17) in accordance with law, by passing a speaking order, within a period of three months. In case, the petitioner is found entitled for the aforesaid benefits, the amount should be released immediately and paucity of funds will be no ground to withheld the due amount.
