It has been asserted on behalf of the petitioner that the Date of Birth of the petitioner is 3.10.1959. It has further been asserted that in the application form, this is the date that was given by the petitioner.
Original record has been produced, which indicates that the Date of Birth given is of the year 1950. Accordingly, the petitioner has been retired.
There is an affidavit, purportedly sworn by the petitioner,

which also declares the Date of Birth as 3.10.1959.
Learned counsel for the petitioner states that the date in the application form has not been filled by the petitioner. The affidavit has not been sworn by the petitioner and it does not contain the signatures of the petitioner.
There are disputed question of fact. Evidence would be required to be taken on oath.
Learned counsel for the petitioner wants to withdraw the petition to take recourse to alternate remedy, as permissible in law.
Dismissed as withdrawn with liberty as prayed for.
