The petitioner is one of the five accused, who had inflicted injuries on the person of complainant Jang Singh and Bant Singh besides causing fire arm injuries to Hamir Singh and Gurmel Singh. So far as the petitioner is concerned, he has not been attributed any injury on the person of deceased Hamir Singh. As per the allegations of Jang Singh complainant, pursuant to a dispute regarding canal water Balkar Singh had shot dead Hamir Singh, brother of the complainant whereas Gurmel Singh had fired a gun shot hitting Manjit Singh on his thigh. Charan Singh had inflicted a gandasi blow on the head of complainant Jang Singh whereas Sukhbir Singh gave a ballam blow on the chest of the complainant. So far as the petitioner is concerned, he is alleged to have given a gandasi blow on the person of Bant Singh, the brother of the complainant. The injury attributed to the petitioner is an incised wound on the face of Bant Singh. As the co-accused of the petitioner Charan Singh, similarly circumstanced, has been granted the concession of bail by the trial court, the petitioner can be granted the similar relief on the principle of parity as he is not alleged to have inflicted an injury on the person of the deceased and that he has
